Terms and Conditions GENERAL TERMS AND CONDITIONS Please read the following terms and conditions thoroughly as they set out the conditions for the use of the EZEAuctions.com web site and the services it provides. If you find yourself unable to agree to any of the terms and conditions contained therein then it is recommended that you do not use this website. If however you agree to the aforementioned terms and conditions then tick the I ACCEPT BOX during the registration process. EZEAuctions Pty ltd reserves the right to amend, or change these terms and conditions at any time and will undertake to inform all registered users of any amendments that may be made. REGISTRATION ELIGIBILITY You must be 18+ years of age to use this site as you are forming a binding legal contract. REGISTRATION Registration to participate in EZEAuctions.com is totally free and does not oblige you to purchase any goods. When registering you must undertake not to give false and misleading information. You must always keep your information up to date as this information is used, once a bid has been won, to furnish the winning bidder with the relevant paperwork and goods. Any misplaced goods or emails due to your inaccurate information will be your responsibility. To be able to bid on the site you must have a valid user name and password. You also authorise us to assume that anyone using your user name and password is you or someone authorised by you. (Please see Payment Obligations) The security of your user name and password will be your responsibility. You should notify us immediately of any unauthorised use of your user name and password that you may detect. BIDDING OBLIGATIONS Please take care when bidding as when you’re bid, be it manual or auto bid has been placed it cannot be withdrawn. And if you have the highest bid at the end of the auction period, you will be the winning bidder and are obliged to purchase item. Before bidding make sure that you have carefully read the product information guide. EZEAuctions.com does not accept any responsibility for the information, Images or the suitability of an item for you, given to us from the seller, retailer or manufacturer and they should be used as a guide only. Please make yourself aware of the delivery costs by using the FREIGHT CALCULATOR on each sales overview. Also any other additional cost that are listed such as Buyers Premium. Bids can be placed either manually or by auto bid. (Please refer to HELP LINK on bidding page) Each auction will start and finish at a specified time and at a nominated minimum bid, Note some auctions may include a Buyer’s Premium. Although auctions generally finish on time, on some occasions there are late bidders. So to make it fair for everybody we have created HAMMER TIME, which monitors any late bids. And if there are any, then we will keep extending the auction for a further 10-minutes until there are no bids for 10 continuous minutes. Once you have place a bid, we will keep you informed via email of your status, wether you are winning or have been outbid. PAYMENT OBLIGATIONS When bidding on an auction you must be aware that you have entered into a binding contract. Therefore you are obliged to meet certain requirements. If you are the winning bidder on an online auction you will be emailed a detailed Tax Invoice/ Payment Request. This tax invoice/payment request clearly defines the winners bid amount, any Buyer’s Premium that may be attributed to the relevant sale, the GST component, freight charges and insurance charges (if applicable). You will then see a link to PAYPAL. (See the how to pay section.) It is important to note that you have 3 Working Days, or 72 hours, (mon-Friday) in which to make this payment. If you fail to adhere to the payment obligations the next highest bidder will be given the option of winning the auction, and will be notified by email. You will also be unable to use any services that EZEAuctions.com provides again. This decision will be at the discretion of EZEAuctions.com. G.S.T. All auction bids and win prices will be G.S.T. inclusive. That is the G.S.T. will be worked out as a percentage of the total sale price. Any other costs associated with the sale such as freight charges and buyer’s premium (if applicable) will also be G.S.T. inclusive. HOW TO PAY All payments will be made via PAYPAL unless prior arrangements have been made. Once you have been successful and Won an auction a Link to PAYPAL will be attached to the relevant tax invoice/payment request. You can access this link in two ways, 1. By going to your account via My Account. 2. We will E Mail you a Payment Request/Tax Invoice. And follow PAYPAL instructions. Any disputes that may arise between yourselves and PAYPAL are not the responsibility of EZEAuctions.com. It is important to note that, unless otherwise specified, prices quoted are in Australian dollars. Once payment has been cleared please allow 5-7 working days for the delivery of the item. Please do not contact us before this time regarding late deliveries. DELIVERIES Once payment has been cleared, delivery will be arranged by registered mail via Australia post, or a courier of our choice. Any goods sent must be signed for on delivery. Please allow 5-7 working days for delivery. Do not contact us before this time regarding late deliveries. YOU’RE INFORMATION MUST BE CORRECT in order to receive your goods. EZEAuctions.com will not be held responsibly for incorrect delivery addresses. RETURN OF GOODS EZEAuctions.com will accept returned goods only if they have been damaged in transit or are “dead on arrival”. Goods must be returned at the buyers cost. If the return item is found to be in good working order, the item will be returned to you and you will be charged all delivery costs. Goods that are returned after a 5 working day period, from delivery date, will not be accepted. Goods that are returned within the allotted period will either then be replaced or credited at full invoice value, at our discretion within 10 working days. After this period any goods then fall under the manufactures warranty, if any. Any warranties will be noted in the lot description.EZEAuctions.com holds no responsibility for the manufacturer honouring their warranties which are under their Terms and Conditions. Please retain your EZEAuction.com Tax Invoice, as this is your Proof Of Purchase if any warranty claims do occur. RETAIL PRICING Any ORP or retail prices noted are indicative only, and are supplied by the retailer, seller or manufacturer and therefore are not the responsibility of EZEAuctions.com. EZEAuctions.com advises all bidders to satisfy themselves as to the value of the item being auctioned. MISUSE OF EZEAuctions.com Any misuse of services provided by EZEAuctions.com will result in the suspension of your use of this service for any of the following reasons; 1. Failure to pay once you have won an auction. 2. Register using information, which is untrue, misleading or inaccurate. 3. Refusal to accept delivery of the item you have won. 4. If you breach any of the terms and conditions set out herein. 5. Make bids in a false name. Any misuse of this web site could lead to the suspension of your account and at our discretion notification of the misuse to your service provider. NO WARRANTIES EZEAuctions.com web site is provided on an as-is basis and only the obligations of EZEAuctions.com are set out in this agreement. EZEAuctions.com gives no warranty or condition other than is laid out within the terms and conditions. It cannot be guaranteed that any services provided within this site will be error free or un-interrupted, or that this site or its server will be virus free. EZEAuctions.com will not be liable for any loss, damages or costs incurred in connection with any problems that may occur in relation to any payment facilities used in relation to the site. INDEMNITY You agree to indemnify and hold us EZEAuctions.com, Eze Auctions Pty Ltd and any staff, directors or affiliates to us or any related companies harmless from and against any claims, demands, proceedings, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable solicitors fees, made by any third party due to or arising out of your breach of this agreement or the terms and policies it incorporates by reference, or your violation of any law or rights of a third party.
